romney says big bird's got to go along with jim lehrer. >> does anyone think it's strange that juan is defending pbs? >> i'm not saying. >> that's it for us, thanks for watching, have a great weekend, bye. >> did mitt romney's post debate victory hit a speed bump with the unemployment rate? we'll break down what the numbers mean. this is special report. good evening, i'm bret baier. president obama is hailing the jobs report, showing a drop from 8.1% to 7.8, as a sign the country has come too far to turn back now. his republican challenger says the new numbers are not the sign of a true recovery, in fact, he says they're telling

a far different story. the government's household survey says that 873,000 people entered the work force. but the employer survey found 114,000 new jobs created, 10,000 of those in government. so, the difference, about 760,000 are apparently not full-time stable jobs, what's known as the real unemployment mark, the unemployed and those too discouraged to look for work remains unchanged at 14.7%. white house correspondent wendell goler begins our coverage of the report and the spin. >> two days after a disappointing debate with mitt romney, president obama looked on the bright side of a merely modest jobs report for september. >> this morning, we found out that the unemployment rate has fallen to its lowest level since i took office. >> in his 15th stop in virginia this year and later his 14th trip to battle ground

ohio, mr. obama painted a picture of an economy that may not be growing as fast as we like, but is at least going in the right direction. >> today's news should give us some encouragement. it shouldn't be an excuse for the other side to try to talk down the economy, just to try to score a few political points. >> but with the labor survey showing just 114,000 jobs created last month the reduced unemployment rate came from different survey showed a huge jump of people working part-time or from their homes. some called it an anomaly and former ceo jack welch says these chicago guys will do anything, can't debate so change numbers. >> and who is participating, who's not working and who's tried to work, but dropped out. all of these things. it just raises the question,

and i think there ought to be a good discussion how this number is calculated. >> labor secretary hilda so least angrily denied the unemployment figure was fudged calling the allegation offensive and republican challenger mitt romney said of the jobs number, this is not what a real recovery looks like. and romney was also campaigning in virginia, running mate paul ryan said of the number of jobs created said we shouldn't have to settle for this new normal. reprizing one of the convention themes that americans deserve better than mr. obama has delivered. critics seized on another line in mr. obama's virginia speech in which he denied believing in an entitlement society which he doesn't believe people are entitled to succeed. aides suggest the opposite. >> we don't believe that anybody is ensilenttitled to sus in this country. we believe in opportunity where hard work pays off and responsibility is rewarded and everybody is getting a fair shot. >> here in ohio, where early voting has already begun,

today's jobs report may have more impact than the one that comes out a few days before the election and that's a plus for the president since ohi gen romney. >> wendell goler travelling in cleveland. and following romney's strong performance in the debate, what happens now? here is chief political correspondent, carl cameron. >> reporter: with a month before election day, unemployment below 8% for the first time in the obama era, mitt romney called it too little, too late and too high since so many have stopped looking for work. >> the truth is if the same share of people participating in the work force today as the day the president got elected our unemployment rate to be around 11%. >> romney's plan says it will create new jobs, instead of part-time, helping to get it

under 8% before the election. i'll help create 12 million new jobs and rising take home pay. >> romney's debate performance intersecting polls, and rasmussen shows romney inching ahead in virginia and ohio albeit within the margin of error and the daily tracking poll has the president up 5 points. romney met privately with laid off miners and blasted the president for waging war with workers, and romney that's an is crucial section of energy independence. >> i think we should put the americans back to work and it's energy abundant and cheap and burned in a clean way. >> and romney with fireworks and country car trace adkins that the president's trillion dollar stimulus would get unemployment lower than it is. >> he said right now we would be at 5.4% unemployment. >> romney pounded joe biden for stating the administration' goal on a trillion dollar tax hike on those making more than 200,000

a year or family 250,000. >> people in the middle class has been squeezed or buried as the vice-president said. and romney's remarks, inelegant. 47%, he renounced it once and for all. >> completely wrong and i absolutely believe, however, that my life has shown that i care about 100%. >> and hoped with those remarks, romney would lay those to rest and close the door on that. to prevent that the democrats were pumping out attack ads to keep it very much. >> bret: carl cameron, on your last point, almost everyone talking about wednesday's debate says mitt romney did pretty well or won, but how he won, that's the question, as carl mentioned, that has entered the post debate spin

cycle. >> governor romney may dance around his positions, but if you want to be president, you owe the american people the truth. >> stretching the truth or worse, that's how mitt romney won the debate. it's now a familiar refrain from democrats. echoed by sympathetic media outlets. >> i give him credit for a strong performance. i give him a "f" for being honest with the american people. >> at the end of the day he failed on the facts. >> governor romney has changed a number of positions or didn't remember some of his positions. >> republicans call it all sour grapes. >> with what this says is that obama got his clock cleaned in the schoolyard and now he and his friends are out there the next day saying, we would have, could have, should have, and making up excuses for why ne lost. >> and even as some democrats make the charge of what they call romney's debate fabrications, they concede, the president should have pushed back on stage. >> in attempt to go sort of be

cool, be presidential, he tried to stay above the frey and ended up looking detached, a bit off and listless and the president in his sort of coolness did know the take mitt romney to task. >> the democrats's big s charge, that romney has a 5 trillion dollar tax cut, he won't be able to pay for. one that will force a $2000 tax increase on middle class families. that's all based on a study by the tax policy center, which originally said romney's plan could only be deficit neutral with a tax hike on the middle class, but jim angle fact checked that for us. >> the tax policy center later changed its assessment if romney put all deductions on the chopping block, then, quote, there is no reason why that full reform proposal would have to raise taxes on middle class households and the scholar objected to the way the obama campaign used their research saying quote, i

don't use this as governor romney wanting to increase taxes on the middle class... ♪ . >> bret: when pressed about the 5 trillion dollars tax cut charge, obama advisor stephanie cutter eventually conceded the point. >> it's a 5 trillion dollar tax. but it's not going to be anywhere near 5 trillion dollars. >> okay, stipulated, won't be near 5 trillion dollars, but it's also not going to be the sum of 5 trillion dollars and the loopholes he's going to close, it will cost someone. >> they'll say they can do that, but one thing i say is not true is-- >> which brings us back to the truth and finding it in this campaign. and remember this clip that never made it into the 60 minutes broadcast. >> what the fact checksers had problems with the ads on both sides and say that they've been misleading and in some cases just not true. does that disturb you? i mean, some of them, some of them are your ads. >> do we see sometimes us

going overboard in our campaign, mistakes that are made or the areas where there's no doubt that somebody could dispute how we are presenting things? i mean, you know, that happens in politics. i think-- >> aren't the american people entitled to the truth or a better version? >> the truth of the matter is most the time we're having a vigorous debate about a vision for the country and there's a lot at stake in this election. so, is it going to be short sometimes, absolutely. >> and says that the democrat spin has been some sort of messaging after a very tough debate. >> it wasn't just a loss, it was a devastating defeat for the president and that's obvious to everybody across the spectrum. i have seen people agree on this particular point about that debate that i haven't seen agree on anything for years. people are never going to give as much credence to post debate spin as they do to what

>> new arrests today on last month's deadly assault in libya. james rosen has tonight's update on the investigation. >> reporter: one day after fbi agents made their first inspection of the benghazi consulate and annex where u.s. ambassador chris stevens and three other americans were murdered, a turkish broadcaster announced the arrest of two tunisians and called them suspect in the case. u.s. officials swiftly contacted them and they had no report on the action, they had an explanation why the fbi took so long to visit the so-called crime scene. >> we were working with the government of libya to obtain permission for the fbi team and the dod support team to

travel there. we did seek over flight for them permission as well as for landing of aircraft and we worked to get them the appropriate visas, so we've been working through all of these perm metations. >> that the perpetrators may have different nationalities or fled to far-flung countries exposes the myriad difficulties the fbi faces in hunting down the killers. >> and the intelligence operation and the way in which globalization helps because we can check passports more quickly, we can figure out which may be fraudulent and which may be associated with suspect terrorists. >> the state department panel led by former u.s. ambassador thomas pickering held a meeting today. separately a spokesman acknowledged in an e-mail exchange that included ambassador stevens last may the department rejected that a state department airplane be kept in tripoli for his and other's use. >> i think it was a dc-3, but

>> the fbi now believes the death of a u.s. border patrol agent early tuesday morning near the the arizona mexican border may have been a case of friendly fire. 30-year-old nicholas ivie was fatally shot and another agent wounded. investigators are trying to determine if the men shot each other and the police say they were under hostile fire. the investigation was continuing. republican senators are urging defense contractors to ignore white house guidance about layoff notices to employees. the administration has told companies not to issue legally required advisories before the election, ignoring what's called the war act and requiring notification and the

administration is also promised to cover any of the contractors legal costs if they're sued for not sending out those notices. and senators john mccain and lindsey graham say they will block any such reimbursements and that compliance with the law is not optional. the man who heads the firm shall accused of voting fraud, is defending his firm tonight. senior correspondent eric shawn has that story. >> bret: the head of the company at the center of the voter fraud allegations says thinks firm will be vindicated. >> i think we did a very good job. >> a republican operative claims a handful of exworkers for violating company policy and the law. his company, strategic allied consulting is being investigated by florida authorities. >> when law enforcement looks into that situation, what they'll find our company had a systemic effort of quality control at that looked for people trying to cheat the

system. when we found them we fired them and we have a long paper trail a handful of people we caught cheating the system were fired and turned over to investigators for prosecution. >> of 5,000 workers, he says that fewer than 10 did something wrong. out of florida out of 50,000 forms only about 150 have raised problems and in north carolina out of 15,000 forms, only 5 were flagged. he says his firm also registered democrats, but that the truth has gotten lost. >> rumor and innuendo run rampant, i think it's a sexy news story 30 he days out from a presidential election to scream the word fraud. it's unfortunate. >> as a result, he's thinking of getting out of the business. >> registering voters is critical to the success of our country and to the electoral process and if there's such a toxic climate associated with it now, i doubt very few other people will attempt to do

congressman todd akin in the real clear politics average of show-me state senate polling. on undecideds are eyebrow raising 10%. >> this is probably two-thirds pro republican undecided so there's enough there, i think, for akin to make up the difference, if he gets the help he needs. >> help has been in short supply in the last three weeks since his gaffe about quote, legitimate rape. and shunned by national republican leaders including mitt romney. >> basically we lift the barn and they put the barn on top of us. in suburban st. charles county. it's not akin folks are mad at. >> we've probably had nor people looking for akin signs after the way he was treated by the party establishment folks in washington d.c. >> i am reluctant to support the g.o.p. because they are not supporting akin. >> i think they threw him under the bus.

caught a lot of of people by surprise this morning. 114,000 jobs added according to the bureau of labor statistics. inside those numbers though, part-time work, and also the underemployment number stayed the same at 14.7%. you can take a look at the chart for all of unemployment numbers since president obama has taken office and there you see kind of the track. and we are september 12 there at the end. and headed in the right direction if you're president obama's campaign politically, but what about inside the numbers economically. let's bring in our panel, steve hays weekly standard. charles lane, washington post and syndicated columnist, charles krauthammer. charles? >> well, the numbers are tricky because when you get a drop in the rate and then you get this anemic job-- anemic increase in the numbers of jobs, they contradict each other. the reason that you can these

contradictions, each of them comes from a completely different survey. the anemic rise in new jobs comes from the survey of employers and it's a huge and vast survey. where one out of every three employers is collected. whereas the unemployment rate comes from the survey of households where it's only 6/10 of 1% of 1% of all households are being surveyed. so, you've got a very small sample. it doesn't mean that one is right and the other is wrong, but it could mean that the second one where you have this very small one you could have huge fluctuation. we don't know which is right except for one things, austan goolsbee who was the president's economist says the only one you can rely on is gdp in the economy and you can only get unemployment stagnant or rise, so at this rate of

growth which is less this year than last year, less last year than the year before, we are headed for higher unemployment despite the fluctuations that we saw today. >> bret: charles is right, chuck, that a lot of experts looked at this and saw conflicting data. they saw-- some of them saw statistical anomalies for it to drop that much and as you heard mitt romney quote there that if the same number of people were in the work force as when president obama took office, the real unemployment, the unemployment rate would be about 11.1%. yet, politically, for the obama campaign, it is a psychologic psychological-- >> well, there's kind of an economic mystery here and a total nonhistory. let' do the latter first. the nonmystery is clearly a huge break for the president, especially coming right after he had so much trouble in denver at the debate and any

democrat would be trumpeting this number. and the economic mystery how the number could come down two weeks after the federal reserve chairman turned on the money press because he was so worried about the condition of the job market. he used the term grave, to describe the job market. grave concern to be exact. and talked about how weak the labor market was going forward and he was very worried about the fiscal cliff, europe, even china waning, all of these threats to the job market to cause him to open up quantitative easing. that tells me either this number eventually will get some kind of statistical correction to it or-- >> revision. >> president obama better watch out for the november unemployment number. >> two days before the election. >> two days before the election and we should all hope, i don't want to be misinterpreted, that unemployment does in actuality keep going down. >> and chuck is exactly right. that's why this is short-term, obviously, good news for the president, but can go around

and say what he said today. this is the lowest rate since he's become president, but the possibility, if you believe as i do, and as people a lot smarter than i do, that this is some kind of a statistical anomaly, the likelihood of some kind of necessary correction, just days before the he election is significant. i mean, if you go back and you look at the household number which generates the rate you're talking about, a potential jump in employment of 873,000 jobs, which we haven't seen, would be the single greatest one in three decades in this time frame, that is virtually impossible for the reasons that these two gentlemen have suggested and-- >> and shorthand for folks at home. because they're characterizing what the definition of a job is, and-- >> that's part of it. that's part of it and it also may be reflective of the dangers of a small, much smaller sample and the volatility of a smaller sample. there are any number of explanations why it happened,

new rasmussen poll out today in ohio and this does not include, i don't believe, so october 4th. so this would have been, yeah, so it would have included debate coverage. the 3rd was the debate. so, that's very close or closer, according to the scott rasmussen in his polling in the state of ohio. i want to go back to the number. hispanic and latino unemployment. quickly, if you look the at the graphic from 2008 to 2012 and you look at the difference here and the numbers as they're adding up. you're talking about 10% overall unemployment according to bls, in september of 2012. that's not sitting well in the hispanic community and the talk today to the executive director of the hispanic leadership network. >> hispanics are looking at the unemployment rate which has been stuck at 10% and above for the last 44 months,

friday lightning round poll and 21% of the votes, this is a story that we broke on fox, the administration trying to get defense contractors not to send out notices warning of sequestration layoffs that may be coming at the first part of the year depending on what happens with those budget cuts. not only that, but the administration promising to pay legal fees, if those contractors get sued because the employees who get fired, if they get fired, sue the companies because they didn't get the notices. senator lindsey graham got pretty fired up about it this week. >> this is a huge deal and it is a mini coup. you're having the executive branch unilaterally telling the private sector to ignore a congressional statute. again, what kind of president would do this in the future? what would stop future presidents from ignoring laws that they don't like. and graham and mccain this despied the administration's

sending warn noticing, the law that requires you to send out the notices it's our fear should you rely on that guidance and fail to comply with the warn act requirements, you will be setting your company up for seriously repercussions and the congress should not put the taxpayers on the hook if the company fails to follow the law. charles? >> and that's exactly right. it's another example of the administration's lawlessness. for example, in the dream act, which is telling the ice, immigration department, not to enforce a large area of immigration law, that was an amendment that was rejected explicitly by the congress. they're doing it again here and this is lawlessness squared, they're saying not only should you break the law, but if you're sued we're going to use the money that we get in taxes, as a way to protect you in the lawsuit. this is, you know, the executives obligation is to
